British Major General Robert Ross was a forty-seven-year-old, blue-eyed Irishman. He had grown up in the same region of Northern Ireland that Sam Smith’s family had emigrated from. He had been personally selected by one of Britain’s most famous military leaders, the Duke of Wellington, to lead an expedition on America’s East Coast. A general for only a year, he had already proven himself many times in battle after battle across Europe. Brave and daring, he was known as a strict disciplinarian but also considered straightforward, fair, even easygoing. He stayed by his troops in battle and earned their undying loyalty. Seriously wounded in the neck in a battle in southern France earlier that year, he had accepted the American command with some hesitation. He had arrived in American waters only the previous month.

Ross would later tell Key that Beanes “deserved much more punishment than he had received; but that he felt himself bound to make a return for the kindness which [had] been shown to his wounded officers.”

Just like that Ross had decided to free Beanes. No legal arguments or pleas for sympathy were needed from lawyer Key, though according to his later account, he made sure to sing the praises of Beanes’ good character. Recalling the event years later, Skinner gave Key no credit for winning Beanes’ freedom. According to the accounts, Skinner’s negotiation wasn’t required either.
